These Terms and Conditions ("Terms") govern the provision of services by D3SING, a studio specializing in 3D modeling, rendering, and architectural visualization. By using our services, you agree to these Terms.

1. INTRODUCTION
Welcome to D3SING. This document outlines the terms governing the relationship between clients and our studio. We are committed to delivering high-quality services while ensuring compliance with Italian, European, and international regulations.

2. PURPOSE AND SCOPE OF SERVICE
D3SING services include, but are not limited to:

• 3D modeling (architectural, technical, structural, MEP, furniture, and urban).

• Realistic rendering using state-of-the-art software.

• Optimization for 3D printing and digital manufacturing.

• Consulting on BIM standards and construction regulations.

• Prototype development for industrial design.

Each service will be regulated by a customized contract, establishing specific conditions for each client.

3. CUSTOMIZED CONTRACTS
Each client and project is unique. D3SING offers tailored contracts that may modify or supplement these Terms. These contracts will include:

• Scope of service

• Delivery deadlines and modifications

• Payment conditions

• Confidentiality clauses

• Intellectual property and usage rights

In case of conflict between these Terms and a customized contract, the contract’s provisions will prevail.

4. COMMUNICATION
All communication between D3SING and the client must occur through official channels (email, phone, or video call). D3SING is not responsible for misunderstandings resulting from informal communication via social media or other unofficial channels.

5. PROHIBITED USES
The client may not use the models and renders provided by D3SING for:

• Resale, redistribution, or sublicensing without prior authorization.

• Illegal projects or those that infringe third-party rights.

• Modification or reuse of files without explicit permission.

• Commercial, advertising, or promotional use without express authorization.

Failure to comply with these conditions may result in legal action.

6. INTELLECTUAL PROPERTY AND USAGE RIGHTS
6.1. Ownership of models and renders

• Until full payment is received, all generated files remain the property of D3SING.

• Once the total amount is paid, the client receives a license for use, but not ownership of the copyright.

• The client may not resell, modify, or distribute the models without prior authorization.

• If the client wishes to obtain exclusive rights and request the complete removal of D3SING’s name from the project, this must be expressly stated in the contract and may involve an additional cost.

6.2. Project display
D3SING may publish projects on its website and portfolio if the client explicitly authorizes it in the contract.
6.3. Legal protection
The designs and models created by D3SING are protected by the following laws:

• Italian Civil Code (Art. 1655 et seq.) – Regulates service provision.

• Italian Copyright Law (Law 22 April 1941, No. 633) – Protects intellectual property.

• General Data Protection Regulation (GDPR – EU 2016/679) – Protects client information.

• Berne Convention for the Protection of Literary and Artistic Works – International copyright regulation.

7. PAYMENT AND BILLING TERMS
7.1. Payment methods

• 40% advance payment at project initiation and 60% upon completion.

• Accepted payment methods: bank transfer, PayPal, secure digital payment.

7.2. Electronic invoicing
Electronic invoices are issued in accordance with Italian legislation.
7.3. Cancellations and refunds

• No refunds are issued once the work has begun.

• If D3SING cancels the project, a proportional refund or alternative solution will be offered.

• If the client cancels the project before completion:

  • The 40% advance payment is non-refundable.

  • An additional charge may be applied based on work already completed.

8. DELIVERY TIMELINES AND MODIFICATIONS

• Delivery times will be specified in each contract.

• Two (2) free revisions are included; additional revisions will incur an extra cost.

• D3SING is not responsible for delays caused by client’s lack of information.

9. DATA PROTECTION AND CONFIDENTIALITY

• D3SING complies with GDPR – EU 2016/679 and protects client privacy.

• If additional confidentiality is required, a Non-Disclosure Agreement (NDA) can be signed.

10. ERROR REPORTING AND FEEDBACK
Clients can report errors or provide feedback through official contact channels.

11. LINKS TO OTHER WEBSITES
Our website may contain links to third-party sites. D3SING is not responsible for the content or privacy policies of such sites.

12. WARRANTY DISCLAIMER
D3SING does not guarantee that its website or services will be free from errors or interruptions.

13. LIMITATION OF LIABILITY
D3SING shall not be liable for:

• Failures in third-party software or hardware.

• Economic losses due to misuse of files.

• Delays caused by force majeure.

• Unintentional errors in the delivered files.

• The client is responsible for reviewing and validating files before final use.

14. GOVERNING LAW AND DISPUTE RESOLUTION

• These Terms are governed by Italian law and applicable international regulations.

• Any disputes shall be resolved in the courts of Modena, Italy, unless both parties agree to an alternative dispute resolution.

15. CHANGES TO TERMS AND CONDITIONS
D3SING reserves the right to modify these Terms at any time.

16. PROHIBITION OF USE BY MINORS

• D3SING services are strictly for individuals 18 years and older.

• D3SING does not knowingly collect data from minors.

• If a minor accesses the services without proper authorization, the contract will be canceled without a refund.

17. RECOGNITION POLICY

• D3SING reserves the right to be credited as the author in projects it has contributed to.

• If the client does not want D3SING to be publicly credited, they must request this explicitly in the contract.

• D3SING may include images, renders, or excerpts of the project in its portfolio unless the client prohibits it through a confidentiality agreement (NDA).

18. CONTESTS, SWEEPSTAKES, AND PROMOTIONS
18.1. Eligibility

• Only individuals 18 years and older may participate.

18.2. Prizes and Delivery

• Prizes cannot be exchanged for money or transferred without D3SING’s authorization.

• D3SING is not responsible for external issues preventing prize delivery.
